Zoophilia is a paraphilia that links sexual attraction by a human to an animal. Person’s who have this “animal-attraction paraphilia” are called zoophiles. Paraphilia is defined as a complex psychiatric disorder which involves deviant sexual behavior usually not considered sexually arousing to others. The term was first used by sexologist Friedrich Salomon Krauss and first used in the Diagnostic and Statistical Manuel of Mental Disorders (DSM), in 1980. Paraphilias can often fall into three catorgies: Using Inanimate objects, suffering and humiliation, and sex with unwilling partners. In recent years with the advent of the Internet, horrific “Crush” videos, torture of innocent animals by means of trampling, stomping to death ( usually shown done by a female in high heels), and/or crushing has made it’s appearance within the bestiality circle of abuse and crime. All in the name of sexual exploration and excitement.
According to statistics, paraphilias are more common among males than among females, some sources quote a 20 to 1 of male to female ratio. Psychoanalysts theorize paraphilia is repeating or reverting to a sexual habit that arose early in life or is an expression of hostility in which bazaar/deviant sexual behavior is a means of obtaining revenge for a childhood trauma. Behaviorists suggest that paraphilias begin through a process of conditioning.
Some paraphilia cases show a pre-disposing factor such as difficulty establishing and maintaining personal relationships. Paraphiliacs may choose an occupation, or develop a hobby or volunteer work, that enables them to remain in contact with their desired sexual stimulation. An example of this scenario is the police officer or security guard that is employed off hours by a veterinarian. The officer than has sexual access to the animals that are boarded or being cared for. An older term Zooerasty, refers to objectified sex between a human and animal. Zoosadism refers to having a history of torturing animals. Zooerasty is now referred to as bestiality in mainstream twenty-first century society, which includes human and animal sexual activity.

Exodus 22:19 Anyone who has sexual relations with an animal must be put to death.
Leviticus 18:23 Do not have sexual relations with an animal and defile yourself with it. A woman must not present herself to an animal to have sexual relations with it; that is a perversion.
Leviticus 20:15 If a man has sexual relations with an animal, he must be put to death, and you must kill the animal.
BIBLICAL REFERENCE REGUARDING THE TREATMENT OF ANIMALS
Proverbs 12:10 A righteous man cares for the needs of his animal, but the kindest acts of the wicked are cruel.
When God created Adam He had already created animals which He called good, and gave Adam the choice of naming them (Genesis 2:19). When Noah built the Ark, there was instruction from God for the provision and care of the animal kingdom to continue to survive. When Noah stepped out of the Ark after the flood waters had subsided the animals stepped out with him on dry ground. In the glorious future we will see the wolf live with the lamb, the leopard will lie down with the goat, the calf and the lion and the yearling together, and a little child will lead them. The cow will feed with the bear, their young will lie down together, and the lion will eat straw like the ox. The infant will play near the hole the cobra, and the young child put his hand into the vipers nest. They will neither harm for destroy on all my holy mountain, for the earth will be full of the knowledge of the Lord as the waters cover the sea ( Isaiah 11:6-9).
We are told in Isaiah 65:25, The wolf and the lamb will feed together,…. in the new Heavens and New Earth. The Bible states all the animals are the Lords. Psalm 50:9-11 “I have no need of a bull from your stall or of goats from your pens, (10) for every animal of the forest is mine, and the cattle on a thousand hills. (11) I know every bird in the mountains, and the creatures of the field are mine.”
Animals are all part of God’s loving, holy creation plan and we are instructed by God to care for their needs (Proverbs 12:10). Ultimately, we will be held accountable for what we did or didn’t do concerning the treatment of God’s creation of the animal kingdom. God did not intend for man or woman to use and abuse animals for their sexual gratification. The death penalty was required in the old Testament for such serious and deviant crimes against nature. Human with animal sexual activity is perverted and blatant sin. It shows complete disregard for God’s divine creation of both humans and the animal kingdom. God refers to such activities as defiling yourself which is defined; “To pollute, make filthy or dirty.” Our family pets are not the only ones in possible danger from such sexual predator crimes. Farming animals in rural communities across the world are some of the most frequently abused.
PORNOGRAPHY, BESTIALITY AND CHILDREN
With the advent of Internet pornography, the demand for deviant sexual material has continued to increase in popularity. Generated revenues of pornography with bestiality as its theme have become big business globally. Psychological studies have shown abused children often become abusive adults. Role modeled cruelty and aggression towards both human and our planets non-human animal kingdom leaves an imprint in the mind of a child.
THE MACDONALD TRIAD
THE MACDONALD TRIAD – WARNING SIGNS FOR THE TENDENCY TO KILL
The “MacDonald Triad,” developed in 1963 by J. M. MacDonald in his article, “Threat to Kill”, in the American Journal of Psychiatry, includes cruelty to animals as one of three major personality traits in children that are said to be warning signs for the tendency to become a serial killer. The other two factors within the MacDonald Triad are fire starting (just for fun and destruction), and bed wetting beyond an age deemed normal by medical professionals.
Parents passing personality and attitude traits onto their children is no surprise to God with Biblical warnings concerning generational blessings and curses (reference article, “Addiction Definitions And Hypothesis”). But it is also the consensus of belief among psychologists and criminologist that cruelty to animals can develop into violent behavior and cruelty towards humans. The FBI relates animal abuse and cruelty to be one of the predictors of violence and considers past animal abuse when profiling killers. The U.S. Department of Justice emphasizes the importance of including animal abuse when assessing youth who are at risk of committing interpersonal violence. Criminal animal abuse statistics are not only found among rapists, murderers and serial killers but also in regards to general criminal behavior such as theft and burglary.
A study in 1997 by the Massachusetts Society for the Prevention of Cruelty to Animals and Northeastern University found that seventy percent of all animal abusers have committed at least one other criminal offense and that almost forty percent had committed violent crimes against people. They also found that over a twenty year period, a group of individuals who had abused animals as youths were five times more likely to commit violent crimes, four times more likely to commit property crimes and three times more likely to have drug or disorderly conduct offenses than a matched group of non animal abusers.
It is apparent in documented evidence that the sadistic killing patterns of animals by children are often used as an educational training ground of past experience by many notorious serial killers. A few examples of such violent “Antisocial Behavior” can be seen among sexual serial killers; Ted Bundy, *David Berkowitz (a.k.a.”Son of Sam” use to start fires), Albert De Salvo, (also known to possibly be the “Boston Strangler”), and Jeffery Dahmer.
David Berkowitz accepted Jesus Christ as his personal Savior while incarcerated. He has a prison and writing ministry proclaiming the truth of God’s word to all who will listen. David is now nick named “The Son Of Hope” by all who know him. I have communicated with David Berkowitz by way of letter on several occasions with questions concerning my research. SEX ADDICTS WHO HAVE TORTURED AND MUTILATED ANIMALS
I cite a few example accounts of abuse, torture and mutilation of our God given non-human companions. Nellie, a female black cat was autopsied showing evidence of having been sodomized, with both her back legs and her neck having been broken. She had massive abdominal injuries. Innocent Nellie was found with her rectum stretched to 1.5 inches in size. Nellie, is just one of many animals Barry Herbeck, 35, tortured and mutilated. Herbeck, a former carpet installer, would answer “Free to Good Home” ads, and take his son and daughter along to get the animals. He had a 20 year criminal history that included 1st degree sexual assault on his 6 year old step daughter. Herbeck was sentenced on July 6,1998, (offender # 109551), to twelve years, 2 years in prison for each of the six counts he had been charged with, the longest sentence for animal cruelty in the history of the United States. He claimed to have killed and tortured numerous cats and dogs while continuing to victimize and abuse his daughter by making her witness his violent cruelty and murder of the animals. Herbeck claimed by killing the cats it helped him cope with stress/anger he experienced from past abuse he was subjected to as a child. He claims he killed the animals to release pent up anger he suffered from being physically abused by his stepfather and sexually assaulted by a neighbor.
Then there is the case dated Aug. 2, 2005, of Daniel Smart, 32, who ran out of his Shreveport, La. home an International pornography distribution company that sent snuff and bestiality films all over the world, including Europe and Asia. Having profited more than $2 million dollars, half of his home was devoted to the production of DVDs and tapes. Another case occurred on Sept. 2002, concerning Anthony Goodridge, 34, of Ely, Cambridgeshire, EN (UK), who admitted possessing more than 300 indecent images of girls, some of whom were aged as young as four. The images included film of adults having sex with children. Two contained film classed as “sadism or bestiality”. Goodridge, who worked for Cambridgeshire police for more than eight years, is the father of two sons, age six and fourteen.
The case concerning Christopher Pye, occurred in July 2004, Kamloops, BC (CA). Pye, was caught and convicted of trying to have sex with a friends dog. Pye admitted to police he did it because he had been wrongfully convicted of sexually abusing a child and wanted to do something bad if he was going to jail. Pye was arrested after two people reported seeing a man trying to have sex with a dog in a van. At least three times the witnesses saw Pye, with his jeans around his ankles, try to manipulate the yelping dog into position. Internet pornography was admitted by Pye to psychiatric experts involved in the case as being the contributing factor which lead him to act out and abuse the dog. If you feel these crimes are isolated cases I assure you they are not.
SYNTHIA’S PERSONAL EXPERIENCE WITH BESTIALITY
My personal experience dealing with bestiality came directly from my relationship with Ryan reference story, “Foolish Pleasure – The Love Story Of A Sex Addict, His Betrayal And Crime”. After going through his 5th-step in a Christian 12 step program, which was an honest confession session with fellow member, Anthony, Ryan called me late that night and wanted to come over. It was obvious by the sound of his voice that he was crying. Shortly after Ryan arrived he sat on the floor and held my now deceased and beloved dog, “Pageant”, who died some time later at the age of twelve of a heart attack. Pageant was a loving and regal Maltese who use to follow Ryan around and want to sit in his lap for hours. I knew after researching the 12-step process that the 5th step was emotionally draining but I was not prepared for the situation or the conversation that ensued.
The 5th step reads; Admitted to God, to ourselves, and to another human being the exact nature of our wrongs. When Ryan cried while holding Pageant in his arms, being concerned I continued to probe for an answer to his distressed and unusual behavior. It was then that Ryan told me in – part, of Anthony’s 5th step confession. Anthony had not only confessed to having been involved with bestiality, sexually acting out with a dog, but he also admitted to sexually abusing two young children in his family. Ryan had his own sexual addiction problems and could not handle the burden of Anthony’s bestiality involvement.
To this day it troubles me that Ryan seemed more upset by the bestiality confession than by Anthony’s sexual abuse of children. Late that night while still being emotionally and physically distressed from both his own confession and Anthony’s confessions, Ryan broke down and needed another person to confide in. I was the only person besides God himself who knew first hand of Ryan’s sexual addictions, his past and what he had been through (in part), emotionally as a child. I audibly prayed with Ryan that night who was still gently holding Pageant. I also prayed for Anthony and the two young children he sexually molested.
SEX ADDICTION AND ITS CRIMES ARE NOT A RESPECTER OF PERSONS
Ryan had questioned why God had allowed him to be partnered with Anthony for his all important 5th step in the 12 steps confession session. In Ryan’s opinion he and Anthony had little in common. Ryan “appeared to be a model citizen,” outwardly strong, educated and successful while Anthony was struggling to just get by and make ends meet. Sex addiction and its crimes are no respecter of persons. I looked at Ryan that night, now tears running down both our faces and stated, “I believe God allowed you to hear Anthony’s 5th step confession to show you where you could be if your behavior and sexually acting out doesn’t change. It was a divine warning and act of God in my opinion, displaying his mercy, grace and love” God gives us all such warnings.
The 5th step confession session between two addicts has a vow of secrecy concerning the confessions. Sin thrives on such secrets. Ephesians 4:11-12, “Have nothing to do with the fruitless deeds of darkness, but rather expose them. (12) For it is shameful even to mention what the disobedient do in secret.” The sex addict needs the power of the Holy Spirit to help fight his “Goliath” of a demon and/or demonic oppressions. Fellow addicts are each in the same predicament, coming to battle without being spiritually equipped with the full armor of God. What they truly need is the faith and spiritual authority of mature anointed men and women of God to agree in prayer and fasting for deliverance power sent from heaven above. Addicts also need to be shown human compassion, mentor-ship, and accountability within the local church community, allowing God’s grace, mercy and love to be self evident.
Addicts know other addicts will accept them for who they are, behavior deficits and all. However, they fear being found out by those who they believe will not accept them. It is the negative fear of abandonment and rejection that plagues their spirit, so they hide behind false persona’s they believe people will accept. Meanwhile, bestiality, pedophilia and the crimes that follow such abuse continue to rise, as our world continues to grow in negative hostility, lustful sin and degradation.
Crush Video’s are horrific, evil crimes of torture committed against the animal kingdom (reference story, “Eat The Dog Food”). A person, usually a female, dressed in sexy clothing and high heels will often cuddle, pet and show loving affection towards an animal, such as a kitten, then place them on the ground and torture them to death with the heal of her sexy shoes. This is done as a form of sexual gratification, and is often times followed by sexual indulgence, and/ or orgies. This same type of dark and demonic evil is seen in snuff pornography committed against human beings, usually a female, where they are tortured to death during acts of sex. FIGHTING A BATTLE OF GLOBAL PROPORTIONS
It is a sinful epidemic that requires much prayer and fasting from God’s anointed to fight a battle of global proportions. If you are struggling with bestiality and sex addiction and would like to accept Jesus Christ as your personal savior, please read the articles, “A Free Gift” and “My Sacred Journey Home.” If you are a Christian, please pray a prayer of protection over our beloved children and the animal kingdom, and say a second prayer to God for the sexual predator to give his/her heart and life to Jesus Christ. James 5:16 …The prayer of a righteous man is powerful and effective.
REPORT CRIME PERPETRATED AGAINST ANIMALS
All 50 States have legislation relating to animal abuse. Most States categorize it as a misdemeanor offense, and 30 States (as of 2006), also have institute felony-level statutes for certain forms of cruelty to animals. Report any and all animal abuse, regardless of the age of the perpetrator to: Police, Animal Control and Social Services. This is a protective precaution not only for the animal involved, but also children who may be in arms way of becoming victims of abuse and domestic cruelty. If possible document such crimes with photos, video taping and eye witness accounts, noting both time and date of your report.
WE BECOME THE VOICE FOR INNOCENT CHILDREN AND ANIMALS
Use your legal documentation in dated letters not only to the person you reported the crime to, but also their boss. If it is the police, take down the name of the person you gave your report to and ask at that time the name of the chief of police, in order to send him a formal letter and a copy of your report. Send copies of your efforts to your state officials (example: In the United States send copies to your state Governor). Again follow up with phone calls and additional letters outlining such crimes as they occurred and ask what progress has been made in the case. We become the voice for innocent children and animals who cannot speak. Become pro-active and support and petition for state and country bestiality laws that protect animals and prosecute such criminal crimes. As often in life, it is the positive efforts of a few that provide a better life for many!

I do not agree with Peta’s ad featuring Hugh Hefner’s main girlfriend, Holly, nude on the cover of Peta’s Magazine. Sexual objectification of women and/or animals is unjustifiable. Hopefully others will likewise voice their disapproval at such distasteful and questionable publicity and advertising campaigns. Holly is most often seen naked and barring it on the television show “The Girls Next Door,” without even blinking a false eye lash. I doubt it took much persuasion or conviction for Holly to strip down for animal rights. Such hypocrisy against women in the name of animal rights makes me wonder the motives behind this organization. Thank God there are other animal rights organizations to lend support, that place humanities overall health and spiritual wellness as a top priority. This ministry being one of them!

The Horror of Bestiality / Zoophilia
Bestiality and Zoophilia are formal names for the very sick and repugnant practice of having sex with animals
I knew so little about this practice until I started researching for this article. I am appalled that it is not only legal in many countries, but is actually on the rise in places like Germany, Denmark and Sweden. I am also appalled at the amount of material on the internet and the websites that permit it to be shown, photos as well as videos.
Make no mistake, anyone, usually men, who indulge in this practice, are dangerous. Violence towards animals in any form is usually the first step towards a depraved and violent lifestyle towards others. This is not my opinion, this is fact.
Instead of writing further, I have chosen to provide links that will explain the law in different countries, further references, such as articles and petitions, which I hope you will take the time to sign. There are some photos below as I am a firm believer that you need to face these atrocities and not sweep them away under the cover of denial.
Rape is Rape
The link between animal abuse and crimes against humans has been well documented over several decades. Many studies in psychology, sociology, and criminology during the last 25 years have demonstrated that violent offenders frequently have histories of serious and repeated animal cruelty. The FBI has recognized the connection since the 1970s, when its analysis of the lives of serial killers suggested that most had killed or tortured animals as children. Other research has shown consistent patterns of animal cruelty among perpetrators of more common forms of violence, including child abuse, spouse abuse, and elder abuse.
According to a 1997 study done by the Massachusetts Society for the Prevention of Cruelty to Animals (SPCA) and North-eastern University, animal abusers are five times more likely to commit violent crimes against people and four times more likely to commit property crimes than are individuals without a history of animal abuse.
That said, communities have good reason to be concerned about the whereabouts of animal abusers who often repeat their violent crimes against helpless animals, and often go on to victimize people as well.
Given it is proven that people who can commit crimes against animals rarely stop there and that they are very likely to harm other humans, especially children or other vulnerable people, we are calling on the European Union to place animal abusers on the same level as sex offenders and other criminals by listing them in an online register, complete with a range of personal information, a recent photograph, home addresses and places of employment.

“Freddie the Dolphin” (1991, UK) – man accused of masturbating a well known tame dolphin at sea. Charged with a “lewd act”. Acquitted. Expert witnesses testified male dolphins use their erections not just sexually, but socially as well, and no sexual inference could be drawn. Judge summing up said of the £30,000 trial cost, “this has been the most expensive lesson in dolphin sociology that he has ever heard of”
Kenneth Pinyan (2005, USA) – man died following anal penetration by a stallion, which was filmed by his friend. The death led to rapid introduction of laws in the state against sex with animals.
Cambodia (2005) – man caught having a “passionate embrace” in bed with dog, by wife, confessed he loved the dog more and they separated. Cambodian police commented: “As police, we could only solve the problem of his wife then wanting a divorce. We cannot solve the problem of his relationship with his dog, because under Cambodian law it is not strictly illegal… It is amazing, but this husband is not crazy. It seems he is a passionate human being who looked at a dog, and the more he looked, the more passionate he became.”
Wisconsin, USA (2007) – Bryan James Hathaway was convicted for having sex with a dead deer. The court case raised some interesting legal issues because the statute prohibits sex with animals, but not carcasses. The defence raised the issue that if a dead animal was an animal, at what point would it cease to be an animal.

On date of 26 September, 2012 the EU has confirmed the official registration of this petition. The petition is now registered under the number 812/2012 together with the petition started by the Italian organisation AIDAA (the Italian animal welfare and environmental protection association).
Furthermore, we have received confirmation that the European Parliament decided to ask the European Commission to conduct a preliminary investigation of the various aspects of the problem, and that the Committee on Petitions will continue its examination of petition 812/2012 as soon as it is in receipt of the necessary information.
In our request to the EU, we had also included the implementation of an animal abuser registry. This part, however, has not been specifically acknowledged by the Committee on Petitions, so that we have decided to start a new petition about this topic that we have also submitted for registration.

Bestiality is a worldwide occurrence and Europe is not free from it.
In some countries members of the European Union raping an animal carries no punishment, and in Denmark it is even perfectly legal to run animal brothels. Although the legality of bestiality has been questioned on a number of occasions, a Danish parliament majority believes that it is not necessary to ban sex with animals. The fact that defenseless animals can be legally raped in Denmark in a thriving business where their owners profit from inflicting pain, stress, fear and even death on animals, is a disgrace to the entire country, to say the least.
In Germany the law making it a crime (§175b StGB) was removed in 1969. Bestiality is legal in Denmark, Finland, Germany, Hungary, and Sweden where it was formerly illegal, but made legal in 1994. In some countries, sex with animals is legal as long as long as no physical harm is made to the animal, but it is in the nature of the case that animals are often victims of injury, stress and suffering in connection with sexual acts with humans.
While the world looks upon Europe and especially upon the EU as a model in terms of civilization, a simple search on the internet about animal rape cases that had been reported in Europe – ranging from raped dogs to horses – brings many shocking search results. But the reported cases are just the tip of the iceberg – the number of animals that are regularly being raped by their owners, be it at home or in so called animal bordellos, being unknown. The suffering of these animals goes on behind closed doors, largely ignored because of its shameful nature and as it seems, even by our politicians who fail to address the problem and to create laws that protect animals from this kind of abuse. Because abuse it is. Photos of small animals killed miserably during rape are abundant on the internet.
Sexual abuse of animals is one of the most trivial and obscene expressions of human behavior, one of the sickest practices that can be thought of and we believe it is truly deplorable that there are no EU-laws in place that prohibit and severely punish such sadistic behavior in order to protect defenseless animals.
The undersigned of this petition are calling for an EU wide ban on bestiality, including a ban on zoophilia pornography, making both a punishable crime against animals under EU wide laws.

From making a baby with a horse, to Germany’s erotic zoos, to things you never say in a job interview with law enforcement, these are the top ten bestiality arrests of 2012.
Robert Garrow was born on March 4, 1936. Abused as a child, he grew up raping the family’s livestock and masturbating with the milking machine. He served time in prison, first for theft, then rape. After his release he was accused of sexually assaulting two little girls, and when he failed to appear in court, this budding serial killer became a fugitive from justice.
Maybe no one explained to Andrew Mendoza of Wharton County Texas, that some things are better left unsaid, but Mendoza, who was accused of sexing up the neighbor’s horse, wanted to explain himself and so waived his right to remain silent. Having read the report, this writer really wishes he hadn’t.
In the second report in a month of men sexing up barnyard animals in Florida, Patrick Louis Linn was arrested on September 30, 2012, after a surveillance camera caught him having sex with a stud horse. Strangely enough, Linn knew about the security cameras, because he was caught by those same cameras, doing the same thing, in 2010.
SEX WITH ANIMALS BANNED
GERMANY’S upper house of parliament, the Bundesrat, has voted to criminalise for the first time ”using an animal for personal sexual activities” and to punish offenders with fines of as much as $34,000.
It was the final legislative hurdle for a bill the lower house passed in December.
The vote follows months of debate that pitted so-called zoophiles against animal rights and protection advocates. Sexual mores seemed not to play a paramount role.
The ban, which carries only a misdemeanour charge, is an amendment to the country’s animal protection law, which, among other things, regulates animal testing and the sale of animals, and prohibits animal abuse, including ”using an animal for personal sexual activities or making them available to third parties for sexual activities and thereby forcing them to behave in ways that are inappropriate to their species”.
Zoophiles argue that their relationships with their pets, or ”partners” as they prefer, are entirely mutual. Michael Kiok, a co-director of Zoophilic Engagement for Tolerance and Enlightenment (ZETA), said animals were perfectly capable of expressing whether or not they desired sex.
Animal-rights groups have criticised the move. But David Zimmermann, who is also a co-director of ZETA, said: ”It’s a sexual aspect that is entirely foreign to most people. They just see a man and think, ‘What terrible things is he doing to that dog?”’
Mr Zimmermann had a Great Dane with which he occasionally had sex but it died four months ago, he said. Now he lives with his similarly zoophilic boyfriend and their celibate Dalmatian.
”For me, she’s just a good friend that I care about very, very much. There’s no sex,” he said.
The Crime of Bestiality/Zoophilia: Sexual Assault of an Animal
Taboo as a subject to be sure, sexual crimes against animals are not exceptional, isolated incidents. The case facts run a wide range – from individual animals assaulted by their owners in their homes, to organized bestiality events held at clandestine, often rural locations. Not surprisingly, limited research – such as a 2002 study – places these crimes in the context of what experts in animal abuse and criminal justice refer to as “the link,” i.e. the well-documented connection between violence to animals and violence to humans. Below are some examples of media-covered incidents, and a non-exhaustive collection of news stories on bestiality cases can be found on pet-abuse.com.

Thirty-six states (and three U.S. territories) have laws which expressly criminalize the sexual assault of an animal, though these provisions are often poorly equipped to accomplish meaningful convictions. Those states without such statutes are left to consider charges via their anti-cruelty laws, laws which, due to both the nature of the criminal conduct itself and the often lengthy lapses between the assaults and any investigation or examination of the animals, are often ill-fitting for successful prosecutions. Additionally, mental health evaluations are not usually mandated by law for animal abuse cases – they are most often ordered only at the discretion of the presiding judge.
As with other types of criminal cases of animal abuse, the animal victims in bestiality cases are in danger of being returned to their abusers if the state laws are weak or underutilized on the issue of forfeiture. Where the law requires that an “evidence” animal must wait out the weeks and months of a pending criminal prosecution before (ideally, upon the abuser’s conviction) being legally available for adoption, it is a bitter – and often costly – frustration for all involved. Where post- and pre-conviction forfeiture options are limited, other remedies may be available. The following states and territories have no direct prohibitions against the sexual assault of an animal, though most will have included the issue of bestiality in their definitions for child/elder abuse or obscenity law: Alabama, Connecticut, Florida, Hawaii, Kentucky, Nevada, New Hampshire, New Jersey, New Mexico, Ohio, Texas, Vermont, West Virginia, Wyoming, District of Columbia, Guam and American Samoa.

In addition to a legislative model for “Sexual Assault of an Animal,” ALDF’s collection of Model Laws includes language for an “Offender Registration & Community Notification” statute, as well as a “First Strike and You’re Out” provision. Offender Registration would require convicted animal abusers to register with their community, much like sex offender registration programs currently in use across the United States. “First Strike and You’re Out” proposes mandatory sentencing orders for convicted animal abusers, prohibiting them from having contact with animals for at least five years.

|Zoophilia is broadly defined as the affinity or sexual attraction by a human to a non-human animal. See Wikipedia, Zoophilia, http://en.wikipedia.org/wiki/Zoophilia (describing the emotional and sexual attraction of humans to animals) (as of June 24, 2008, 15:48 GMT). More recently, the term “zoosexuality” has been used to more accurately reflect the full spectrum of a “human/animal orientation.” Id. The term “bestiality” is often used interchangeably with “zoophilia,” though some suggest that this is inaccurate. Id. In the legal system, the term bestiality is most often used to describe human-animal sexual activity without specifying the requisite sexual act. This is in addition to use of the term “sodomy,” which not only covers sexual acts with animals but also certain human sexual acts. (For more on the history and psychology of zoophilia, please see the above Wikipedia link).The legality of zoophilia (otherwise termed bestiality) is not controlled from the federal level. The only relevant federal law is the sodomy law under the military code. This law provides that “[a]ny person subject to this chapter who engages in unnatural carnal copulation with . . . an animal is guilty of sodomy.” 10 U.S.C.A. § 925, 10 USCA § 925. The penalty is derived through court martial. However, as one might expect, the statute applies only to military personnel.It should be noted that it is not unusual for this type of societal issue to be controlled at the state level. Due to the interaction of federal power and state rights, most laws that deal with the health, safety, and welfare of citizens occur at the state or even local levels. This is especially true of criminal laws. Bestiality statutes occur as part of the criminal code; thus, each state determines the terms and penalty for the activity.That being said, approximately 30 states have enacted laws that prohibit sexual contact between humans and animals. For ease of seeing which states have bestiality laws, these states have been listed below along with a designation for whether it is a felony (F) or a misdemeanor (M):
While many of these laws date to the last century or earlier, there have been recent additions of bestiality laws, particularly as part of amended cruelty code. Notably, those states without specific bestiality laws do usually include some reference to bestiality in their child protection laws. These laws, while not included on the website, concern the exhibition of sexually explicit materials containing acts of bestiality to children, or the inclusion of children in the making of such materials.
The slight majority of these states make bestiality a felony. Of the 30 some states, 16 make such acts a felony. What is interesting about the felony designation is that many of these states dictate a lengthy penalty for violation of the law. For instance, Georgia law includes a prison term of one to five years. Idaho makes it a felony with a sentence of not less than five years. Massachusetts has a term of imprisonment not exceeding twenty years or less than seven.
In 2008, the Michigan Court of Appeals held that an animal cannot be a “victim” for the purposes of sex offender registry. People v. Haynes , — N.W.2d —-, 2008 WL 4365966 (Mich.App.). In this case, the defendant pleaded no contest to committing an “abominable and detestable crime against nature” with a sheep under MCL 750.158. In addition to sentencing consistent with being habitual offender, the trial court found that defendant’s actions evidenced sexual perversion, so the court ordered defendant to register under the Sex Offenders Registration Act (“SORA”). Defendant only appealed the propriety of the trial court’s order requiring him to register as a sex offender. The Court of Appeals reversed the order, holding that while sheep was the “victim” of the crime, registration was only required if the victim was a human being less than 18 years old. The court found that MCL 750.158 encompasses two categories of crimes: “abominable and detestable crime[s] against nature” with a human being, and “abominable and detestable crime[s] against nature” with an animal. SORA defines “listed offense” as including a violation of section 158 if a victim is an individual less than 18 years of age. Relying on the plain and ordinary meaning of “victim,” the court concluded that an animal was not intended to be considered a victim under the statute.
Recently enacted or amended laws focus on the necessity of psychological counseling for perpetrators of bestiality (See Arizona and Washington for instance). Other recent laws impliedly focus on the lack of consent in the activity, terming the action a “sexual assault.” Older laws term the activity a “crime against nature” or “unnatural act with an animal.” One scholarly legal article included on our website addresses briefly the legal status of bestiality statutes and the historical bases for these laws. Another law review article (not included on our site) suggests that these laws may not be directed at the lack of consent on the part of the animal, but rather society’s attitude toward sex itself. Pets or Meat? by Mary Ann Case, 80 Chi.-Kent L. Rev. 1129 (2005). The author raises the difficult issue of how to differentiate the act of bestiality from other “tricks” pets are forced to perform, sometimes through coercion. Finally, famed animal rights philosopher Peter Singer wrote a controversial essay entitled, “Heavy Petting,” in which he suggests that “mutually satisfying activities” could occur without involving cruelty to the animal. Singer insinuates that our discomfort with zoophilia stems more from our view as separate and morally superior from the rest of the animal world rather than the direct harm to the animal itself.
Regardless of the philosophical platform from which one views the activity, bestiality is criminally sanctioned in many states. Even if a state does not specifically proscribe the activity, it may be covered under other aspects of a state’s sex crimes code or even the anti-animal cruelty law. As with any other legal question, it is imperative to contact a licensed attorney in your state to answer any specific questions about the law.
Wake County man accused of crimes against nature with dogs
21 year old Seadon Collin Etienne Henrich, of 6717 Steves Drive in Zebulon, was taken into custody Thursday and charged with four counts of a crime against nature and three counts of felony dissemination of obscenity.
The arrest warrants state that Henrich committed sex acts with dogs over an 18 month long period of time that spanned between May 2011 and November 2012. He additionally emailed photographs of the illegal acts to others and posted them online, according to Wake County Chief Magistrate Dexter Williams.
Section 14-177 of the North Carolina General Statues, states: “If any person shall commit the crime against nature, with mankind or beast, he shall be punished as a Class I felon.” A
Henrich, who will have his first court appearance Friday, is being held at the Wake County jail by a $70,000 bond.
